Terms and Conditions for Workout Smart Trainers
Effective Date: June 16, 2025
These Terms and Conditions govern the participation of independent fitness professionals (“trainers”) in the Workout Smart Partner Program. By working with clients under the Workout Smart brand, you agree to the terms outlined below.
Trainer Responsibilities
- Trainers must deliver safe, personalized training programs that align with Workout Smart's philosophy of progressive, long-term fitness.
- Trainers are expected to maintain accurate and up-to-date certifications in fitness instruction, CPR, and liability coverage.
- All client interactions, including assessments and ongoing sessions, must be conducted professionally and ethically.
Client Data & Confidentiality
- Trainers must treat all client information—including intake forms, health conditions, and fitness goals—as strictly confidential.
- Client data must not be shared with any third party without explicit written consent.
- Trainers are required to store digital and printed records securely and ensure they are only accessible by authorized personnel.
Brand Usage
- The Workout Smart name and logo may only be used in promotional materials that have been pre-approved by the Workout Smart team.
- Trainers may promote the 50% discount program for clients, provided all marketing is accurate and does not misrepresent the offer.
Compensation & Offers
- Trainers partnering with Workout Smart may extend a 50% discount to their clients on designated services, subject to prior approval.
- Payments and incentives will be handled through direct agreement between Workout Smart and the trainer. These arrangements must be confirmed in writing.
Termination
- Workout Smart reserves the right to terminate any trainer partnership at its discretion if conduct is found to be unprofessional or if these terms are violated.
- Trainers may end their partnership by providing written notice to trainer@workoutsmart.ca.
Modifications
Workout Smart may update these Terms and Conditions periodically. Continued participation in the program after changes are posted implies acceptance of the updated terms.
Client Liability and Risk Acknowledgment
IMPORTANT: All clients and users acknowledge that they will follow any and all programs at their own risk. At no time are Workout Smart Personal Training, its staff or personal trainers responsible, accountable or liable for any adverse effect or impact experienced by anyone who chooses to follow these programs in whole or in part.
By purchasing or using any Workout Smart services, you hereby attest that you have read these Workout Smart Terms and Conditions and fully agree to indemnify the company and its representatives, trainers and associates in all situations.
